Most people do not know what qualifications to look for when they want to hire a divorce lawyer. The main reason is that unlike other lawyers required for property disputes or purchase of properties under foreclosure or cases of bankruptcy, you are not geared for a divorce right after you set up a family. Nor do we discuss legal aspects of a divorce as much as we do in other civil cases.
The best information we can collect on matters of divorce law or lawyers is advice from a friend or referral from an acquaintance. It warrants some close scrutiny and diligence on your part to retain legal counsel.
If you feel comfortable to ask friends to recommend a divorce lawyer, you may do so to start with.
You can check a major law firm directory on the web. Some websites have a directory of family law and divorce certified specialists. After browsing through the list, you should shortlist some lawyers based on where they practice and if possible what their qualifications are. You can subject your list to a few checks as follows.
You should ensure that the lawyer you choose in the first screening, practices in the county under your legal jurisdiction. The intricacies of family law differ from one county to another.
Check the credentials of the shortlisted lawyers. In particular you should check the following.
(a) The first criterion to check is whether the divorce lawyer has a good standing with your state bar.
(b) There is no single benchmark for a good divorce lawyer. A generally accepted benchmark for divorce lawyers is online. You could contact the local bar council for help if you haven't been able to find someone to recommend a good divorce lawyer. Another credential you should check is a Family Law Specialization certification. If you have a difficult case and are in a position to pay liberally, you may include one or more certified family law specialists. Once you have narrowed the field to a small number of candidates, fix up meetings with each of the divorce lawyers on the list.
(c) You should be careful to see that the divorce lawyer you consult is fairly responsive to your needs. You have to make sure that your family law attorney is able to devote adequate time to your case. Experience shows that if it takes 3 working days for the lawyers to respond, it is an indication that they are too busy to give proper attention to your case.
(d) When you meet with your shortlisted lawyers, discuss with them their experience about cases similar to yours. In case you presume that there would be a custody battle, you can find out if the lawyer has handled similar cases earlier.
The attorney you interview may not be one to be assigned to your case. Meet the person who will actually take up your case and discuss with him thoroughly your case.
With a bit of research and effort you will be able to find a divorce lawyer that suits your needs. Don't hesitate to clear all your doubts and queries before you do engage the services of a lawyer to handle your case.
