People only opt for divorce when they hit a point when they cannot stay married anymore with their spouses. Sometimes it is better to get a divorce than fighting with each other regularly. However, the feeling of separation is really painful not only for the couple but others as well, be it their children or other family members. But many of us do not know that getting a divorce in US can be equally painful for you to stay in a troubled marriage if you do not have any idea about the divorce laws in the country.
Divorce law is probably the most complicated thing ever faced by an American citizen. It is not all about separating just two people but other issues such as living space, finance, custody of children, and much more. As the marriages in US are not sanctioned by the government but by the states there are 50 different sets of rules. Each state in US preserves a few particular rights for each partner in a divorce. Most US states support 'no-fault divorces' where couples get divorce citing 'irreconcilable differences'. But some other reasons such as physical or mental abuse, infidelity, criminal behavior are also there citing any of which a spouse can get divorce.
The state in which the couple files for a divorce is likely to handle the entire procedure. On the other hand if both the partners file for divorce at the same time but in different states arbitration will be necessary then to decide which state has proper governing body to handle the matter. As the different state has different divorce law, the arbitration is necessary. For example, while in California the property is divided equally between the separated couple, in Nevada they get 'equitable division' which means, the one who earns more will get the more after annulling the marriage. Apart from New Mexico, Texas, California, Washington, Louisiana, Idaho, Wisconsin and Arizona all other states of US follow the 'equitable division' law.
Children are the most common as well as innocent victims of this entire process. Initially at the beginning of 20th century only the husbands were allowed to take care of their children. Then it was the wife who used to get the sole custody of them. But now the rule has changed and become more flexible, where both husband and wife get the primary custody of their children. However, the rule differs from state to state. If both husband and wife want to retain the primary custody of their children they need to appoint a good lawyer to handle the issue which involves both a good heart and a good amount of money.
Division of pension after the retirement is also a major issue for the elderly couple heading for a divorce. Earlier military personnel used to get the entire pension alone in spite of having their wives for 18 to 20 long military years. But the rule has been changed now and both of the get equal share of the pension.
